Welcome to Club Desi (“we”, “our”, “us”). These Terms and Conditions (“Terms”) govern your access to and use of our website, mobile application, and related services (collectively, the “Platform”). By using Club Desi, you agree to these Terms. If you do not agree, please do not use our services.

• Customer/User: Any person placing an order through Club Desi.
• Restaurant Partner: A food provider listed on Club Desi.
• Takeaway Order: An order placed for pickup by the customer from the restaurant.
• Delivery Order: An order delivered by a delivery partner (where available).
• Platform: Club Desi’s website, app, and associated services.

3. Eligibility
You must be at least 18 years old and capable of entering into legally binding agreements under Australian law.

4. Services Provided
Club Desi acts as a marketplace platform connecting customers with restaurants. We do not prepare food and are not responsible for its quality, safety, or compliance with food standards. Restaurants are solely responsible for food preparation and allergen information.

5. Ordering and Payment
• Orders are placed via the Platform and confirmed upon payment.
• Prices include applicable taxes and any service fees.
• Payment methods accepted: [Credit/Debit Cards, Digital Wallets].
• Club Desi uses secure payment gateways; we do not store card details.

6. Takeaway Orders
• Customers must collect their takeaway orders from the restaurant within the agreed timeframe.
• Risk and title of food pass to you upon collection.
• Club Desi is not responsible for food quality after pickup or delays caused by late collection.

7. Delivery Orders (Where Available)
• Estimated delivery times are indicative only.
• Risk and title of food pass to you upon delivery.
• Delivery partners are independent contractors; Club Desi is not liable for delays caused by traffic, weather, or other factors.

8. Refunds and Consumer Guarantees
Under Australian Consumer Law, you are entitled to remedies if:
• Food is not provided.
• Food is unsafe or not as described. Refund Process:
• Customers must first raise issues with the restaurant via the in-app support feature.
• If unresolved within 48 hours, escalate to Club Desi via admint@clubdesi.com.au.

9. Allergies and Dietary Requirements
Restaurants must provide accurate allergen information. Club Desi does not guarantee allergen-free meals. Customers with allergies should contact the restaurant directly before ordering.

10. User Responsibilities
• Provide accurate details for pickup or delivery.
• Collect takeaway orders promptly.
• Do not misuse the Platform or engage in fraudulent activity.
• Respect restaurant staff and delivery partners.

11. Intellectual Property
All content on Club Desi (logos, text, images) is our property or licensed to us. You may not copy, distribute, or exploit our content without permission.

12. Limitation of Liability
To the extent permitted by law:
• Club Desi is not liable for food quality, preparation, or health consequences.
• We are not responsible for delays or failures caused by third parties.

14. Termination
We may suspend or terminate your account for breach of these Terms or unlawful activity.
